OBAMA DEFENSE OF MARRIAGE ACTPresident Obama Defense of Marriage Act Unconstitutional Sedition and Treason By Delwyn Lounsbury - THE DEFLATION GURU President Obama and Attorney General Eric Holder announced on February 23, 2011 the Defense of Marriage Act unconstitutional. They concluded "a more heightened standard of scrutiny" is needed for sexuality types of classifications. So, the Section 3 of DOMA the Defense of Marriage Act ruled unconstitutional by Obama was just out of the blue. DOMA, Section 3, defined marriage as a legal union between one man and one woman only. Doma is a law. Obama cannot just call a law unconstitutional. Essentially, Obama said the feds will stop upholding DOMA in states that have passed same-sex marriage laws - Connecticut, Iowa, Missouri, New Hampshire, Vermont, District of Columbia and California. If Obama is allowed to do this end run around our legal system he could undo any enacted federal law he doesn't like. Does this mean when Obama is defeated in 2012, the new President can just decree the 2,700 page bloated and inefficient ObamaCare unconstitutional? This fascist trick may backfire on the Democrats and Obama. The Fourteenth Amendment Equal Protection Clause prohibits discrimination based on sexual orientation as well as race. Only the judicial branch and ultimately the Supreme Court have the authority to determine scrutiny of legislation enacted by Congress. Did President Obama consult with the Solicitor General? Did he discuss it with Elena Kagan (appointed a Supreme Court Justice by him) when she was still Solicitor General? If so, Kagan will have to recuse herself on any future sexual orientation cases that reach the Supreme Court - including this Defense of Marriage Act. People don't realize President Obama did a big seditious and illegal end run around the other branches of government by using hand picked White House czars to head up his many departments. He circumvented the customary Senate confirmation and vetting procedure. A few of them were communists and all are leftist statists. All these czars with little control in what they do and what new regulations they impose seem to be a thinly veiled communism bordering on fascism. Obama's EPA czar and comrades can make up new onerous regulations and go around legislative restraints to push for business killing cap-and-trade agreements. It would bring on socialism and new-world-order/one-world-government agenda that scares me silly. Think "Big Brother." If we don't stop President Obama's constant disobeying the Constitution this is what we will get. We will be told what to do, where to work and what to think. Impeach this tyrant! Who is Obama to decide a laws constitutionality? That's the judicial branches' job or let Congress repeal this mean spirited law. It was a bad idea in the first place. Is this an Obama "wag the dog" to mask his troubles getting the budget approved, his $1.5 trillion budget deficit, chronic unemployment, the flack he is getting over not producing a doctor signed long-form certificate of live birth, the Obama fast and furious gun scandal, the Solyndra Solar Obama failure and a deflation economy turning into the greater depression? The Defense of Marriage Act was passed by large majority votes in both houses of Congress (Senate 85-14, House 342-67) and signed into law of the land by President Bill Clinton on September 21, 1996. It's Public Law Number 104-199, 110 stat. 2419, if you want to look it up. Isn't it the Supreme Court's job to decide whether a law is unconstitutional or not? The administration is obligated by the Constitution to continue enforcing a law until it is either repealed by Congress or finally declared unconstitutional in court. President Barack Hussein Obama has now told the Justice Department not to defend a federal law. It's dereliction of duty on Obama's part. It's sedition not to obey or uphold a law. Sedition carries a 20 year prison sentence plus fine. President Obama sedition knows no boundaries. He is also disobeying a brave Federal District Court Judge, Roger Vinson, who recently ruled ObamaCare unconstitutional. The Constitution says the feds can't make us buy only their health insurance plan and be fined if we don't. That's the "individual mandate." The leftist Democrats in their rush to grow the size of government forgot to put in a severability clause. A severability clause would let the rest of the act continue if one part was found invalid. ObamaCare that seeks to put 16 percent of a free economy under inefficient government control is, therefore, unconstitutional. The Constitution was carefully drafted to prevent any future kings, dictators or foreign control. Our founding fathers wanted checks and balances between the executive, the legislative and the judicial branches of government. Obama's big government socialism is stomping on the other branches of government. He is foreclosing our freedom and our liberty by purposely ruining our Constitution. Obama also disobeyed a judge's ruling he did not have the authority to shut down all oil drilling in the Gulf of Mexico during the British Petroleum oil well leak disaster. President Obama has done five or more seditions by my count. Why did he get a Nobel Peace prize and the $1 million that comes with it? He hadn't done anything yet. Was it from a power elite prepayment for future wet-work on our constitution and leading us blindly into a one-world government? It appears so. DOMA says that no state (or other political body inside the United States) needs to treat as a marriage a same-sex relationship considered a marriage in another state. DOMA, Section 3, defined marriage as a legal union between one man and one woman. DOMA is an unprecedented intrusion by the U.S. Congress into an area usually left to individual states. I am for states rights. Let each state decide whether they will allow same-sex marriage. All U.S. citizens deserve happiness in their lives. Let's not discriminate against gay and lesbian couples and their families. DOMA does more harm than good since it prevents same-sex couples from receiving spousal benefits like Social Security. It also does not give them the ability to sponsor a partner for citizenship or the ability to jointly file federal taxes, among many others. Impeach this seditionist Obama. He put his hand on the Bible and swore to uphold the laws of the land. Is he even a citizen? Let's see his hand typed long-form doctor signed certificate of live birth. He has spent over one million dollars of his own money blocking those seeking the truth in this matter. There is the fifth sedition, by the way. He is lying and not proving he is a citizen as required by law. If he had a real birth certificate would he spend a million dollars or just furnish a copy? President Obama is turning into a fascist tyrant and demigod. Think Hitler and Mussolini. Protect and defend our constitution before it is too late and a "Big Brother" government takes the last of our freedom and liberty.
